CWCI General Counsel Roles & Responsibilities

Primary Role
General Counsel’s primary responsibility is to manage the legal affairs of the Institute, analyze legislative and regulatory issues, providing responsive testimony to the regulator, staff the Legal Committee, and direct the Institute’s amicus activities.

Corporate Secretary
As the Corporate Secretary, General Counsel prepares the official minutes of the Board of Directors, Executive Committee, and the Legal Committee.

Regulatory Activities
General Counsel analyzes proposed regulations and prepares responsive testimony articulating CWCI members’ positions.  General Counsel testifies at regulatory hearings and disseminates the Institute’s comments to the industry and other stakeholders.  Once new statutes and regulations are implemented, General Counsel coordinates the Institute’s training programs on the changes in the law for the workers’ compensation community.

Legal Committee – Amicus Activity
General Counsel staffs the Institute’s Legal Committee and that committee, with the oversight of the Executive Committee, determines the level and direction of the Institute’s amicus activity.  The Legal Committee allows Institute members to present a strong voice in every significant appellate case affecting the California workers’ compensation system from the appeals board through the Supreme Court.  The General Counsel’s Legal Committee responsibilities include:  

  • Setting the committee agenda
  • Conducting quarterly meetings and recording the minutes
  • Analyzing pending cases to determine Institute participation as amicus curiae
  • Coordinating the Institute’s amicus activities with other system stakeholders
  • Gathering and disseminating industry-related information

Educational Seminars & Webinars
General Counsel is primarily responsible for preparing and presenting the annual Case Law Seminar and participates in the preparation and presentation of other seminars and webinars.  General Counsel prepares the Significant Decision briefs on new workers’ compensation opinions from the WCAB, District Courts of Appeal, and the Supreme Court.  General Counsel also attends external seminars and conferences on workers’ compensation issues.

Legislative Activities
General Counsel responds to requests from industry government affairs representatives or insurer trade associations to provide a technical review of pending legislation.  General Counsel may also participate in legislative hearings.

Research
As part of Senior Staff, General Counsel will address legal questions affecting various Institute studies, coordinate the research input of the Legal Committee, and review draft research studies for content.

Strategic Planning
General Counsel participates in the development and presentation of the annual strategic planning session for staff and the Executive Committee.

Internal Operations
General Counsel participates in a variety of internal corporate policies, legal issues, and corporate law questions that arise for the Institute, including:

  • Contract review and dispute resolution
  • Disaster Recovery Plan
  • Antitrust Compliance
  • Record Retention Policy
  • Human Resources Issues
  • FPPC Reporting
  • Leasing – Property & Equipment
  • Data Security Review
  • Copyright Litigation
  • Financial Authority

Additional Activities
General Counsel participates in all CWCI Committees’ meetings and various stakeholder advisory groups.

Member Relations
General Counsel attends various meetings with individual members and communicates daily on member conference calls, individual phone contacts, and e-mail exchanges.

Experience & Qualifications
General Counsel must be an active member of the California State Bar with five to ten years’ experience in the California workers’ compensation system, preferably as a defense and/or injured workers’ attorney.  Experience drafting appellate briefs, analyzing legislation, and responding to regulatory proposals is highly preferred.  A viable candidate should also demonstrate teaching skills, an ability to manage corporate policies and legal issues, and a general understanding of the Institute’s research initiatives.
